1. Acceptance of Terms

By accessing, browsing, or using the Margdata Trust website (https://margdata.in/), you accept and agree to comply with these Terms and Conditions, our Privacy Policy, and all applicable Indian laws and regulations. Your membership and use of services are permitted only if you agree with the terms described herein and within the Niyamawali (Rules).

These terms constitute a legally binding agreement between you (the "User" or "Member") and Margdata Trust (the "Trust" or "Organization"). Continued use of this website signifies your ongoing acceptance of these terms, including any modifications made from time to time.

2. Definitions

For the purposes of these Terms and Conditions, the following definitions apply:

  • Trust/MD Trust: Refers to Margdata Trust, a registered organization under the Indian Trust Act 1882, Registration Number 85/2025.
  • Member: Any individual who has successfully registered on the website and agreed to these Terms and Conditions and the Niyamawali.
  • Nominee: A person designated by a Member to receive benefits or assistance in the event of the Member's death or incapacitation.
  • Sahyog: Contributions, donations, or mutual assistance provided by Members under the framework of community support and social welfare.
  • Niyamawali: The comprehensive rulebook governing membership, contributions, benefits, and operational procedures of the Trust.
  • Website: The official online platform located at https://margdata.in/ and all its subdomains and pages.
  • Lock-in Period: The mandatory waiting period before Members become eligible for certain benefits.

3. Membership Rules

3.1 Eligibility Criteria

To become a Member of Margdata Trust, you must meet the following requirements:

  • Be an Indian citizen with valid proof of nationality
  • Be between 18 and 55 years of age at the time of registration
  • Provide a sworn agreement to all Terms & Conditions and Niyamawali provisions
  • Complete registration through the official website using accurate and truthful information
  • Possess a valid email address and mobile number for communication
  • Not be a member of any organization with conflicting objectives or interests
  • Agree to participate in the mutual support framework in good faith

3.2 Free Membership

Important: Membership with Margdata Trust is completely free. There are no registration fees, annual charges, or hidden costs associated with becoming a Member.

  • No forced or mandatory registration - membership is voluntary
  • Registration requires submission of complete and accurate information through the online form
  • Members must join official communication channels (WhatsApp and/or Telegram groups) to stay informed
  • Failure to maintain active communication may result in delayed notifications or missed opportunities
  • Members are encouraged to update their profile information regularly

3.3 Termination of Membership

The Trust reserves the right to terminate or suspend membership under the following circumstances:

  • Violation of Terms and Conditions or Niyamawali
  • Provision of false or misleading information during registration or afterward
  • Engagement in fraudulent activities or misuse of Trust resources
  • Failure to maintain communication or prolonged inactivity (more than 6 months)
  • Behavior detrimental to the Trust's mission, reputation, or other Members
  • Non-compliance with Sahyog contribution requirements without valid justification
  • Harassment, threats, or abuse toward Trust staff or other Members

4. Sahyog / Contribution Rules

4.1 Contribution Obligations

Members participate in a mutual support framework where contributions (Sahyog) are made to assist families and individuals in times of crisis. Key principles include:

  • Members must contribute regularly according to the schedule and amounts specified in the Niyamawali
  • Contributions are voluntary in nature but expected from all active Members
  • All Sahyog must be provided honestly and in full compliance with Trust rules
  • Contributions support the broader community and are not individual investments
  • The Trust maintains complete transparency in the collection and distribution of Sahyog
  • Contribution records are maintained securely and can be accessed by Members
  • Members experiencing genuine financial hardship may request temporary exemptions

4.2 Lock-in Periods

Understanding Lock-in Periods

Lock-in periods are mandatory waiting periods before Members become eligible for certain benefits. These ensure the sustainability and fairness of the mutual support system.

  • Standard Lock-in: 90 days minimum from registration date before eligibility for most Sahyog benefits
  • Serious Illness Declaration: 1 year (365 days) lock-in period for Members who declare pre-existing serious health conditions at registration
  • Special Circumstances: Exceptions may apply as detailed in the Niyamawali and at the Trust's discretion
  • Lock-in periods begin from the date of successful registration confirmation
  • Lock-in periods apply to ensure system integrity and prevent misuse
  • Members will receive confirmation of their lock-in completion date

4.3 Serious Illness Disclosure

Transparency regarding health conditions is crucial for fair administration:

  • Members must honestly declare any serious, chronic, or life-threatening health conditions at registration
  • Serious illnesses include but are not limited to: cancer, heart disease, kidney disease, HIV/AIDS, chronic respiratory conditions, diabetes complications, neurological disorders
  • Misrepresentation, concealment, or withholding of health information constitutes grounds for disqualification from benefits
  • The Trust treats all health disclosures with strict confidentiality in accordance with privacy laws
  • Members developing serious conditions after registration must notify the Trust promptly within 30 days
  • Health information is used solely for eligibility assessment and benefit administration

5. Nominee Registration and Claims

Every Member is encouraged to designate a Nominee who will be the beneficiary of Sahyog support in certain circumstances:

  • Nominees must be clearly identified during registration with complete contact details and relationship proof
  • In the event of a Member's death after the applicable lock-in period, the Nominee may request Sahyog assistance
  • Claims must be submitted with proper documentation including death certificate, identity proof, and proof of relationship
  • Claims should be submitted within 90 days of the Member's death for timely processing
  • Important: All Sahyog awards and distributions are made at the sole discretion of the Trust
  • Sahyog is a voluntary community support mechanism and is NOT a legally enforceable benefit, insurance claim, or guaranteed payment
  • Members may update Nominee information at any time by contacting Trust administration
  • Multiple Nominees can be designated with specified percentage allocations
  • Nominees must be legal adults (18+ years) or have a legal guardian appointed

6. Dispute Resolution and Final Decisions

Trust Authority

The Trust operates on principles of transparency, fairness, and community welfare. All administrative decisions are made in the best interest of the collective membership.

  • All disputes related to Sahyog distribution, beneficiary designation, or interpretation of rules are resolved at the Trust's discretion
  • Trust decisions regarding eligibility, claims, and benefits are final and binding on all Members
  • Members may present their concerns or appeals in writing to the Trust administration within 30 days of a decision
  • The Trust will review appeals fairly and objectively but reserves the right to maintain original decisions
  • No Member may initiate legal proceedings against the Trust for Sahyog-related matters, benefit denials, or distribution decisions
  • Disputes between Members should be resolved amicably with Trust mediation if requested
  • The Trust's administrative committee will make final determinations on all disputes

7. Prohibited Activities

The following activities are strictly prohibited and will result in immediate membership termination and possible legal action:

  • Falsification of contribution records, payment receipts, or any Trust-related documentation
  • Submitting misleading, fraudulent, or forged documents for registration, claims, or any other purpose
  • Using Trust membership, name, or resources for personal commercial gain or business purposes
  • Harassment, intimidation, threats, or harmful conduct toward other Members, Nominees, or Trust staff
  • Attempting to manipulate, circumvent, or exploit Trust rules, systems, and procedures
  • Unauthorized use of Trust name, logo, branding, or intellectual property
  • Sharing confidential Member information without proper authorization
  • Creating fake accounts or registering under false identities
  • Soliciting Members for external schemes, businesses, or activities
  • Making false or defamatory statements about the Trust or its Members
  • Attempting to hack, damage, or compromise the website or Trust systems

Legal Notice: No legal claim, demand, or lawsuit can be made against Margdata Trust for contributions, Sahyog distributions, or any decisions regarding benefit awards. All participation is voluntary and subject to these terms. The Trust operates as a mutual support organization, not an insurance or financial institution.

8. Communication and Updates

Effective communication is essential for successful participation in the Trust:

  • Members must check official communication channels at least twice per week to remain updated
  • Official channels include: email, WhatsApp groups, Telegram channels, and website announcements
  • The Trust will issue important notices regarding Sahyog opportunities, rule changes, benefit updates, and administrative matters
  • Members are responsible for maintaining current and accurate contact information
  • Failure to stay informed may result in missed benefits, opportunities, or important deadlines
  • All official communications will originate from verified Trust accounts only (check sender verification)
  • Members should report any suspicious communications claiming to be from the Trust
  • The Trust will never ask for passwords, bank PINs, or sensitive financial information via email or messaging
  • Communication preferences can be updated in Member profile settings

9. Modifications to Terms

Margdata Trust reserves the right to modify, amend, or update these Terms and Conditions at any time to reflect changes in operations, legal requirements, regulatory compliance, or community needs. Changes become effective immediately upon posting on the official website (https://margdata.in/).

Continued use of the website and services after modifications constitutes acceptance of the updated terms. Members will be notified of significant changes through official communication channels. It is the Member's responsibility to review these terms periodically to stay informed of any updates.

Major changes affecting Member rights or obligations will be announced with reasonable advance notice (typically 30 days) before implementation.

10. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of India. The Trust operates in compliance with the Indian Trust Act 1882 and all applicable central and state laws.

Any disputes, claims, or legal proceedings arising from or related to these terms, membership, Trust operations, or services shall be subject to the exclusive jurisdiction of the competent courts in Lucknow, Uttar Pradesh, India.

Members agree to submit to this jurisdiction and waive any objections to venue or inconvenient forum.
